POTS Check Terms of Use

1. Acceptance of Terms

By accessing or using POTS Check ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, you must not use the App.

These Terms constitute a legal agreement between you and Cascade Agentic Labs LLC ("we," "us," or "our"). Your continued use of the App indicates your acceptance of these Terms and any updates.

2. Medical Disclaimer

2.1 Not a Diagnostic Tool

The App is not a medical device and is not FDA-cleared or approved for any medical purpose. The App:

• Does NOT diagnose any medical condition, including POTS (Postural Orthostatic Tachycardia Syndrome)
• Does NOT replace professional medical advice, diagnosis, or treatment
• Should NOT be used to make medical decisions
• Is NOT intended for emergency use

2.2 Consult a Healthcare Provider

Always consult with a qualified healthcare provider before:

• Starting any new health monitoring routine
• Making decisions about your health
• Changing your medical treatment
• Using test results for any medical purpose

3. Intended Use

The App is intended for personal wellness tracking only by individuals who:

• Are at least 13 years of age
• Do not have known serious cardiovascular conditions (unless cleared by a physician)
• Understand this is not a medical device
• Use the App for informational and educational purposes only

3.1 Wellness, Not Clinical Data

POTS Check generates consumer wellness data, not clinical-grade medical data. Test results are:

• Approximations based on consumer-grade sensors (Apple Watch)
• Subject to environmental and physiological variability
• For informational and educational use only
• Not suitable for making medical diagnoses or treatment decisions

4. Your Responsibilities

4.1 Safety First

You agree to:

• Stop testing immediately if you feel faint, dizzy, or unwell
• Follow all safety instructions provided in the App
• Have a safe environment for testing (wall support, ability to sit/lie down quickly)
• Not drive or operate machinery immediately after testing if you feel symptoms
• Inform your healthcare provider about your test results if discussing symptoms

4.2 Data Accuracy and Sensor Limitations

No Medical-Grade Accuracy

This App is NOT intended to provide medical-grade measurements. Test results are approximations based on consumer-grade sensors and should be treated as informational estimates only.

Test Validity Factors

Test results may be invalid or unreliable if:

• You move excessively during baseline or standing phases
• The Apple Watch is not worn snugly on your wrist
• You are dehydrated, caffeinated, or have recently eaten
• Ambient temperature is too hot or too cold
• You have wrist tattoos or dark skin pigmentation (which can affect optical sensors)

Disclaimer: The App provides no guarantee of accuracy, reliability, or clinical validity. Results are for informational and educational purposes only.

4.3 Age Requirements and Parental Consent

Minimum Age: 13

Users must be at least 13 years of age to use this App (COPPA compliance).

Parental Consent Required (Ages 13-17)

If you are under 18 years of age, you MUST have your parent or legal guardian:

• Review and accept these Terms of Use on your behalf
• Review and approve your use of the App
• Understand that the App will collect health data as described in the Privacy Policy

Parental Responsibilities

Parents or guardians who consent to a minor's use of this App agree to:

• Supervise the minor's use of the App
• Ensure the minor follows all safety instructions
• Review test results with the minor
• Seek appropriate medical consultation if test results are concerning

Age Verification

By accepting these Terms, you affirm that:

• You are at least 13 years of age, AND
• If you are under 18, your parent or legal guardian has reviewed and approved your use of this App

Under Age 13

This App is NOT intended for children under 13 years of age. We do not knowingly collect health information from children under 13.

5. Data Collection and Privacy

For detailed information about how we collect, use, and protect your health data, please review our comprehensive Privacy Policy.

5.1 What We Collect

The App collects and stores:

• Heart rate data from Apple Watch (via HealthKit)
• Blood pressure data (ONLY if you manually enter it during testing)
• Test timestamps, durations, and results
• Symptom logs (if you record them, max 100 characters)
• Motion and posture data (via Core Motion framework)
• Device information for app functionality (device model, OS version)

5.2 How We Use Your Data

Guest Mode:

• Your data is stored in-memory only during your active session
• Data is automatically deleted when you close the app or start a new test
• No data is uploaded to servers
• No data is linked to your identity

Secure Account Mode:

• Your data is stored locally on your device in your personal encrypted Solid Pod
• All data is encrypted at rest (ChaCha20-Poly1305)
• Exported data follows W3C Solid Pod format for future interoperability
• Data may be synced to cloud Solid Pods (if you enable this feature in future versions)
• Your data is never sold or shared without your explicit consent

Note: Currently, POTS Check operates as local-only storage. Solid Pod access control policies and cloud synchronization will be available in future versions.

5.3 Your Privacy Rights

You have the right to:

• Access all data the App has collected
• Export your data as a Solid Pod (RDF/Turtle format) or PDF report
• Import previously exported data back into the App (Secure Account mode only)
• Delete any or all of your test results at any time
• Revoke HealthKit permissions at any time via iOS Settings

5.4 We Will NEVER

• ❌ Sell your health data to third parties
• ❌ Use your HealthKit data for advertising
• ❌ Share your data with data brokers
• ❌ Transmit your unencrypted health data to third-party servers

6. HealthKit Data Usage

6.1 HealthKit Authorization

Required Permissions (All Users)

The App requests access to:

• Heart Rate (READ access - required for test execution)
• Workout Sessions (WRITE access - required for continuous heart rate monitoring during test)

Optional Permissions (Secure Account Only - Health Profile)

If you choose to import your Health Profile, you may grant access to:

• Blood Pressure (READ - historical BP from third-party devices)
• Heart Rate Variability (READ - HRV/SDNN data)
• Resting Heart Rate (READ - baseline comparison)
• Walking Heart Rate Average (READ - activity context)
• Respiratory Rate (READ - autonomic health context)

Health Profile import is entirely optional. You can use full testing functionality without importing Health Profile data.

Note: During tests, blood pressure must be entered manually using a separate BP cuff. Apple Watch does not measure blood pressure.

You can revoke HealthKit permissions at any time in:
iOS Settings → Privacy & Security → Health → POTS Check

6.2 HealthKit Data Policy

In compliance with Apple's HealthKit policy:

• HealthKit data is used solely for app functionality
• HealthKit data is not shared with third parties (except as you explicitly authorize via export)
• HealthKit data is not used for advertising or marketing
• HealthKit data is encrypted on your device via iOS Data Protection

7. Limitations of Liability

7.1 No Medical Liability

To the fullest extent permitted by law:

• The App developers are not liable for any medical outcomes resulting from use of the App
• You use the App at your own risk
• The App is provided "as is" without warranties of any kind

7.2 Disclaimer of Warranties

We make no warranties that:

• The App will be error-free or uninterrupted
• Test results will be accurate or reliable
• The App will meet your specific needs
• Any defects will be corrected

7.3 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, in no event shall the App developers (Cascade Agentic Labs LLC) be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of data, profits, revenue, or business opportunities
• Cost of procurement of substitute goods or services
• Any damages arising from or related to your use or inability to use the App

Monetary Cap: In jurisdictions that permit such limitations, our total aggregate liability for all claims arising from your use of the App shall not exceed the greater of: (a) the amount you paid for the App in the 12 months preceding the claim, or (b) $100 USD.

Exception for Gross Negligence: Nothing in these Terms limits our liability for:

• Death or personal injury caused by our gross negligence or willful misconduct
• Fraud or fraudulent misrepresentation
• Any liability that cannot be excluded by law

8. Intellectual Property

8.1 App Ownership

The App, including all content, features, and functionality, is owned by Cascade Agentic Labs LLC and protected by copyright, trademark, and other intellectual property laws.

8.2 Your Data Ownership

You own your test data. The App does not claim any ownership rights over the health data you generate. Your data belongs to you, and you control how it is used and shared.

8.3 License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

9. Changes to Terms

9.1 Updates to Terms

We may update these Terms of Use from time to time. We will notify you of significant changes by:

• Displaying a notice in the App
• Requiring you to re-accept updated terms

Continued use of the App after changes constitutes acceptance of the new terms.

9.2 Right to Modify or Discontinue App

We reserve the right, at any time and without notice, to:

• Modify, suspend, or discontinue the App (in whole or in part)
• Refuse service to anyone for any reason
• Change features, functionality, or availability of the App

No Obligation to Update: We have no obligation to provide updates, bug fixes, or new features. Any updates we release are provided "as is" without warranty.

No Refund for Discontinuation: If we discontinue the App or any feature, you are not entitled to a refund of any fees paid (if applicable).

10. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Washington and the United States, without giving effect to any principles of conflicts of law.

Jurisdiction: You agree that any legal action or proceeding arising from these Terms or your use of the App shall be brought exclusively in the state or federal courts located in King County, Washington, and you consent to the personal jurisdiction of such courts.

11. Apple App Store Terms

Acknowledgment of Apple's Role

You acknowledge and agree that:

• These Terms are between you and Cascade Agentic Labs LLC only, not with Apple Inc.
• Apple has no obligation to provide maintenance or support for the App
• Apple is not responsible for the App or any content within it
• Apple is not liable for any claims relating to the App or your use of it
• In the event of any third-party claim that the App infringes intellectual property rights, Cascade Agentic Labs LLC (not Apple) is responsible for investigation and defense
• Apple and its subsidiaries are third-party beneficiaries of these Terms, and Apple has the right to enforce these Terms against you

Compliance with Usage Rules: You agree to comply with Apple's App Store Terms of Service and Usage Rules, which are incorporated by reference.

12. Export Control and Sanctions Compliance

Export Restrictions

The App uses encryption technology that may be subject to export control laws of the United States and other countries. By downloading or using the App, you represent and warrant that:

• You are not located in, under the control of, or a national or resident of any country subject to U.S. embargo or sanctions
• You are not listed on any U.S. government list of prohibited or restricted parties (including OFAC SDN List, BIS Denied Persons List)
• You will not use the App in violation of any U.S. export control or sanctions laws

Prohibited Jurisdictions: This App may not be available for download or use in certain countries subject to comprehensive U.S. sanctions, including (but not limited to): Cuba, Iran, North Korea, Syria, and Crimea region of Ukraine.

Compliance Responsibility: You are solely responsible for compliance with all applicable export control, sanctions, and local laws in your jurisdiction.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

15. Acknowledgment

When you accept these Terms of Use in the POTS Check app, you confirm that you have read, understood, and agree to be bound by all terms and conditions contained herein.
